Welcome to the Guardian Garden Centre. This site is run and maintained by J Parkers Dutch Bulbs Limited (“J Parkers”). These terms of use govern your use of the Guardian Garden Centre Site and your relationship with the seller of the goods (“Goods”) that you may buy through the site. Please read them carefully. The seller of the Goods is J. Parkers. Guardian Newspapers Limited ("GNL") is not a party to the transaction between you and J Parkers for the sale of its Goods and because of this, you must accept that GNL does not make any warranty about the Goods or their delivery and any claim you may have in respect of the sale of the Goods is with J Parkers and not GNL's responsibility.
Detailed below is a full and complete list of J Parkers's terms of use. J Parkers may amend these terms of use from time to time. The new terms of use will then apply to any future orders by you.
1. Your Contract with J Parkers
To purchase Goods from the Guardian Garden Centre Site you must be over eighteen years of age. There will be no contract of any kind between you and J Parkers unless and until J Parkers actually dispatches the Goods to you. Your order is an offer to buy from J Parkers. Nothing that J Parkers does will amount to any acceptance of that offer until J Parkers actually dispatches the Goods to you. At any point up until then, J Parkers may decline to supply the Goods to you. At the time that the Goods are dispatched, a contract will be made between you and J Parkers as agreed in these terms of use, you will be charged for the Goods at the point of dispatch of the Goods.
2. Prices
The prices payable for the Goods that you order are clearly set out on the Guardian Garden Centre Site. If, by mistake, J Parkers has under-priced any of the Goods, it will not be liable to supply those Goods to you at the stated price, provided that it notifies you before it dispatches the Goods concerned. All prices are expressed inclusive of any VAT payable unless otherwise stated. The price of the Goods does not include a delivery charge. Delivery is only possible to the UK mainland only.
3. Delivery
Delivery will be made to the address specified by you on the completed order form. Please note that J Parkers can only deliver Goods within the United Kingdom Mainland (excluding the Channel Islands and Southern Ireland). As Goods will be dispatched at their optimum growing time. Orders consisting of several different Goods may be delivered separately. Delivery times are dependent upon the item you order, for more information click here.
4. Cancellation and Returns
If you choose not to accept any part of your order, please return it within 7 days. Please report any shortages of items listed on delivery note as soon as possible by calling 0330 333 6862. In the unlikely event of any problem with the delivery, it is imperative for you to fill in the Customer Feedback Questionnaire on the back of the delivery note or contact J Parkers on 0870 836 0730. This will increase the chance of replacement plants being available. If this is not possible then you can include the relevant information on an e-mail to J Parkers at guardiangardencentre@jparkers.co.uk or call 0330 333 6862.
You will be responsible for the costs of returning any Goods unless they have been delivered to you in error or the Goods are faulty. This does not affect your statutory rights.
5. Payment
Our online payment system is a simple and secure method of providing payment for your order. All orders are processed and charged in one payment at the time of placing the order online. We accept payment by the following credit and debit cards – Visa, Visa Debit, MasterCard and Visa Electron. Your credit/debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure.
6. Disclaimer of Liability
To the extent permitted by law, the Guardian Garden Centre Site is provided by J Parkers without any warranties or guarantees. In particular, J Parkers does not warrant that the Guardian Garden Centre Site or any of its contents is virus free. You must take your own precautions in this respect as neither party accepts any responsibility for any infection by virus or other contamination or by anything which has destructive properties. Although J Parkers will do its best to provide constant, uninterrupted access to the Guardian Garden Centre Site, it does not guarantee this. It accepts no responsibility or liability for any interruption or delay.
To the fullest extent allowed by applicable law, you agree that J Parkers will not be liable to you for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Guardian Garden Centre Site.
If J Parkers is found to be liable to you, its liability (whether arising in negligence or otherwise) will not under any circumstances exceed the greater of (a) £500, or (b) an amount equal to the sums paid or payable by you in respect of the order to which such liability relates.
Nothing in these terms of use shall exclude or J Parkers’ liability for personal injury or death caused by negligence.
7. Data Protection
J Parkers collects information from your use of the Guardian Garden Centre Site on behalf of GNL. Your information will be used in accordance with the Guardian Unlimited Privacy Policy.
8. Use of Material on the Guardian Garden Centre Site
For the purposes of this agreement, "Material" means Material including, without limitation, text, video, graphics and sound material, published on the Guardian Garden Centre Site.
You may download and print extracts from the Material and make copies of these for your own personal and non-commercial use only. You are not allowed to download or print the Material, or extracts from it, in a systematic or regular manner or otherwise so as to create a database in electronic or paper form comprising all or part of the Material appearing on the Guardian Garden Centre Site. You must not reproduce any part of the Guardian Garden Centre Site or the Material or transmit it to or store it in any other website or disseminate any part of the Material in any other form.
